The clocks differ by track: for tax deed surplus, claimants other than the former owner generally have 120 days from the clerk's notice and are barred afterward, with unclaimed funds going to the school board. For foreclosure surplus the presumption favors the owner of record on the date the lis pendens was filed, and subordinate lienholders have a longer window following the 2019 amendment to § 45.032. Confirm the current deadline with the clerk — these statutes have changed more than once.
