What a Florida tax deed or foreclosure sale wipes out

Tax deed sales

A Florida tax deed sale extinguishes many private liens, but not all encumbrances. Governmental liens, certain municipal and code enforcement liens, and easements and restrictions of record commonly survive and become the new owner's problem. Florida Statutes § 197.552 governs what a tax deed conveys. Code enforcement liens are recorded by the city, not the county, so the register to search depends on the municipality the parcel sits in.

Foreclosure sales

A judicial foreclosure generally wipes out liens junior to the one being foreclosed, while anything senior survives. That makes lien priority, not lien existence, the question that matters, and priority is decided by recording order. The case number leads to the lis pendens, and the lis pendens date fixes priority against everything recorded after it.

What DeedScope is and is not

DeedScope indexes Florida auction calendar records: parcel, case number, address, sale date, bid and judgment fields. It is not a title search, a title abstract, or title insurance, and it does not read the official records index. Use it to find the sale, then verify title with the clerk's official records and a qualified title professional before you bid.

Not legal, title, or investment advice. Lien survival and priority turn on facts specific to each parcel and each sale.

Professional-use note

DeedScope organizes public auction calendar information for research and workflow speed. It is not legal advice, title advice, valuation advice, or a substitute for county records, court records, title search, property inspection, or attorney review.
