Where Hernando surplus funds come from

When a property sells at a Florida tax deed or foreclosure auction for more than the amount owed, the excess is surplus. The Clerk of Court holds it. Tax deed surplus is governed by Florida Statutes § 197.582; surplus from a judicial foreclosure sale is governed by § 45.032.

Who can claim it

Lienholders are paid first, in priority order, and then the former owner. The clocks differ by track: for tax deed surplus, claimants other than the former owner generally have 120 days from the clerk's notice and are barred afterward, with unclaimed funds going to the school board. For foreclosure surplus the presumption favors the owner of record on the date the lis pendens was filed, and subordinate lienholders have a longer window following the 2019 amendment to § 45.032. Confirm the current deadline with the clerk — these statutes have changed more than once.
