What survives a tax deed sale
A Florida tax deed sale extinguishes many private liens, but not all encumbrances. Governmental liens, certain municipal and code enforcement liens, easements and restrictions of record commonly survive and become the new owner's problem. Florida Statutes § 197.552 governs what a tax deed conveys.
What survives a foreclosure sale
A judicial foreclosure generally wipes out liens junior to the one being foreclosed, while anything senior survives. That makes lien priority, not lien existence, the question that matters — and priority is decided by recording order, which only the official records can tell you.
